Effective date: [[EFFECTIVE DATE]]
These Terms are an agreement between you and [[LEGAL ENTITY NAME]] ("we", "us") about your use of the Vigil app for iPhone and Apple Watch. Please read them. By using Vigil you agree to them. If you do not agree, please do not use Vigil.
You got Vigil from Apple's App Store, so Apple's Licensed Application End User License Agreement also applies to you. These Terms add to it. If the two disagree about the app itself, Apple's agreement wins.
How we handle your information is described in our Privacy Policy at [[PRIVACY POLICY URL]].
Vigil helps you keep a regular time of prayer. You schedule Vigils, and each one leads you through a Liturgy of read and spoken prayer, Scripture and silence.
Vigil is not an emergency, medical, mental-health, counselling or pastoral care service. Nothing in it is professional advice. If Vigil shows you crisis resources, they are provided by others, and Vigil does not contact anyone on your behalf. If you or someone else is in danger, call your local emergency number.
You must be at least [[MINIMUM AGE]] years old, and old enough to agree to these Terms where you live. If you are under the age of majority, a parent or guardian must agree to them for you.
Vigil creates an anonymous account for you when you first open it. You can then sign in with an email address or with Sign in with Apple. Keep access to your email and Apple Account secure: you are responsible for what happens under your account. You can delete your account at any time in Settings › Delete your account.
During setup, you can pray one complete prayer for free. After that, starting a Vigil needs an active subscription. Two plans are offered:
Prices are shown in the app before you buy, in your local currency, and may differ by country and include taxes where applicable. The price shown in the app at the time you buy is the price you pay.
Two things are never behind the paywall: the crisis resources described in §1, and a Vigil that has already started, which is never interrupted.
Each plan may come with a 7-day free trial. Apple allows one free trial per subscription group per Apple Account, and Standard and Premium are in the same group. If you do not cancel at least 24 hours before the trial ends, your subscription starts and you are charged.
Payment is charged to your Apple Account when you confirm the purchase (or when the trial ends). Your subscription renews automatically at the same price and for the same period unless you cancel at least 24 hours before the end of the current period. Apple charges the renewal within the 24 hours before the period ends.
A move to Premium takes effect at once. A move to Standard takes effect at your next renewal.
You can cancel at any time in your Apple Account's subscription settings. Vigil's Subscription screen takes you there. After you cancel, everything keeps working until the end of the period you paid for. Deleting your Vigil account does not cancel your subscription.
Apple handles all payments and refunds. To ask for a refund, use Apple's Report a Problem page (reportaproblem.apple.com) or contact Apple Support. We cannot issue App Store refunds ourselves.
If we have confirmed your subscription before, Vigil keeps working for up to 14 days without a connection. Vigil's plans are not shared through Family Sharing.
We may change what a plan includes or what it costs. Apple will tell you about a price increase as its rules require, and where the law or Apple requires it, you will be asked to agree before it applies to you.
With Premium, Vigil can write a prayer for you, from the words you wrote, if you choose to share them, or from a Bible passage you ask it to pray about, together with the themes you choose. These prayers are written on our server by a third-party AI model (named in our Privacy Policy), under safeguards we set:
Even so, a prayer written for you is generated by a machine and may be imperfect: it may misunderstand you, be theologically imprecise, or simply not fit. It is offered to help you pray, not as teaching, counsel or advice of any kind. Please use your own judgement, and your own church and pastor, for matters of faith and life. You may use the prayers written for you freely for your own personal devotion.
What you write is yours. You give us permission to store it, process it and send it to our service providers only as our Privacy Policy describes, and only to run Vigil for you. Your Intentions are encrypted on your iPhone, and we cannot read them.
If you keep a Vigil together with someone you invite, they will see the display name you choose for that link and the name of the shared Vigil. Do not use a name that is abusive, impersonates someone, or includes someone else's private information. Either of you can leave at any time.
When you use Vigil, please do not:
If you see a prayer that seems wrong, you can report it in the app.
The app, its design, its curated prayer library, its recordings and its other content belong to us or to those who licensed them to us. We give you a personal, non-transferable, revocable licence to use them in the app for your own devotion, while your access is active. You may not republish, sell or distribute them.
Narration uses synthetic voices, recorded ahead of time and labelled "Synthetic" in the voice picker.
Scripture in Vigil is from the Berean Standard Bible, which its publishers dedicated to the public domain in 2023. Scripture text is never machine-translated, and quotations in written prayers are checked against our copy of it.
Vigil has no ads, no in-app currency, and no political or current-events content. We will not offer you an upsell during or at the end of a Vigil.
We may add, change or remove features, and we may stop offering Vigil. If we stop offering it, we will tell you in advance where we reasonably can. Apple's rules on refunds for subscriptions apply.
You can stop using Vigil, and delete your account, at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, or if the law requires it. We will tell you why where we reasonably can. Sections 5 (last paragraph), 7, and 12 to 15 continue after this agreement ends.
Vigil is provided "as is" and "as available". To the fullest extent the law allows, we make no promises beyond those written in these Terms, including about whether Vigil will always be available, free of errors, or suited to your purposes, or about the accuracy of generated content. Prayer, reflection and Scripture can touch hard things; Vigil does not replace care from a doctor, counsellor, pastor or emergency service. Some places do not allow these exclusions, so some may not apply to you.
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of Vigil. Our total liability to you for any claim about Vigil is limited to [[LIABILITY CAP AMOUNT]]. Nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.
Nothing in these Terms takes away rights you have under the consumer laws of the country where you live.
These Terms are governed by the laws of [[GOVERNING LAW]], without regard to conflict-of-law rules. Disputes will be decided by the courts of [[VENUE]], unless the consumer laws of your country give you the right to bring a claim where you live. Before bringing a claim, please write to us at [[CONTACT EMAIL]]: most problems can be solved by talking.
These Terms are between you and us, not Apple. Apple is not responsible for Vigil or its content.
We may update these Terms. We will post the new version at this address with a new effective date, and tell you in the app if a change is significant. If you keep using Vigil after a change takes effect, the new Terms apply. If you do not agree, please stop using Vigil and cancel your subscription.
If part of these Terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we have not given up the right to. You may not transfer this agreement; we may transfer it to whoever takes over Vigil. These Terms, Apple's agreement and our Privacy Policy are the whole agreement between you and us about Vigil.
